NY Foreclosure Answer Deadline Calculator

How long you have to answer a New York foreclosure Summons & Complaint under CPLR 320(a). Self-help, not legal advice.

Enter the date you were served and how you were served in the calculator above to see your estimated answer deadline. Under CPLR 320(a), personal delivery in New York gives you 20 days to appear or answer. Any other manner of service — mail, nail-and-mail, service on someone else, or service outside New York — generally gives you 30 days from the completion of service. For non-personal service, the exact date service is legally "complete" can be later than the day the papers arrived, so confirm the precise deadline with the court or an attorney.

If your deadline hasn't passed

File a written Answer (and raise defenses like standing and a missing or defective RPAPL 1304 90-day notice) before your deadline. Filing on time keeps the case on a normal track and avoids a default judgment.

If your deadline has passed

If a default judgment was entered, you may still be able to move to vacate it under CPLR 5015(a) — see our auction countdown and vacate-default guides.
