There is generally no fixed statutory deadline measured from the sale date — an emergency motion can often be filed right up until the sale — but the sooner you act, the more options you have. This is an urgency guide, not a countdown to a legal cutoff.
More than 21 days — you still have time to act deliberately
An Order to Show Cause (OSC) to vacate a default judgment (CPLR 5015(a)) paired with a stay of the sale (CPLR 2201) and a TRO to halt the auction is strongest if you have grounds such as improper service (CPLR 5015(a)(4), which can void even a completed sale), a missing or defective RPAPL 1304 90-day notice, or a standing/assignment gap. If your judgment is less than 1 year old, excusable default under CPLR 5015(a)(1) is available — it needs a reasonable excuse plus a meritorious defense. If the judgment was entered within the last 30 days, an appeal with a court-fixed undertaking/bond (CPLR 5519(a)(6)) can stay the sale. Ask about the mandatory settlement conference / loss-mitigation track (CPLR 3408).
7 to 21 days — move now
File an emergency OSC with a TRO to stay the sale (CPLR 2214(d), time-of-the-essence) in the Supreme Court where the judgment was entered. You must serve the lender's counsel — typically at least 24 hours before presentment — with proof of service. Backstop lever: filing a Chapter 13 bankruptcy petition triggers an automatic stay (11 U.S.C. § 362) that halts the sale on filing.
Fewer than 7 days, including today — this is an emergency
Two fastest levers. First, an emergency OSC + TRO — it can often still be brought right up to the sale, but judges want notice, so file immediately. Second, filing a Chapter 13 bankruptcy petition imposes an automatic stay (11 U.S.C. § 362) that stops the sale the moment it's filed — a last resort with real consequences. Get counsel today.
Sale date already passed — you may still have options
If the judgment was void for lack of personal jurisdiction (improper service), CPLR 5015(a)(4) can invalidate even a completed sale. Act immediately — do not assume it's over.
